1. Acceptance of Terms

By accessing or using MediaScriber.ai, a product of Brainstormer Innovations Inc. (“Platform”, “Service”), you agree to be bound by these Terms and Conditions.

  • Speaker diarization;
  • Subtitle generation;
  • Summarization;
  • Translation;
  • AI-assisted media analysis;
  • Related APIs and integrations.

Features may evolve, change, or be discontinued without prior notice.

3. User Accounts

Users may be required to create an account to access certain services.

You are responsible for:

  • Maintaining the confidentiality of your credentials;
  • All activity under your account;
  • Ensuring account information remains accurate.

You must immediately notify MediaScriber.ai, a product of Brainstormer Innovations Inc. of unauthorized account access.

4. Acceptable Use

You agree not to use the Platform to:

  • Upload unlawful, infringing, defamatory, or abusive content;
  • Violate intellectual property rights;
  • Process content without appropriate authorization or consent;
  • Attempt to reverse engineer, disrupt, or overload the Platform;
  • Upload malware or malicious code;
  • Use the service for unlawful surveillance or privacy violations.

Users are solely responsible for ensuring they have all necessary rights, licenses, permissions, and consents required to upload, process, transcribe, translate, analyze, or otherwise use any content on the Platform.

MediaScriber.ai, a product of Brainstormer Innovations Inc. does not verify ownership or authorization of uploaded content and shall not be liable for any unauthorized, infringing, illegal, or unlawful content uploaded by users.

Users agree to indemnify and hold harmless MediaScriber.ai, a product of Brainstormer Innovations Inc. against any claims, damages, liabilities, costs, or expenses arising from uploaded content or unauthorized use of third-party materials.

5. User Content and Rights

You agree not to use the Platform to:

  • Upload unlawful, infringing, defamatory, or abusive content;
  • Violate intellectual property rights;
  • Process content without appropriate authorization or consent;
  • Attempt to reverse engineer, disrupt, or overload the Platform;
  • Upload malware or malicious code;
  • Use the service for unlawful surveillance or privacy violations.

5. User Content and Rights

You retain ownership of the media and content you upload.

By using the Platform, you grant MediaScriber.ai, a product of Brainstormer Innovations Inc. a limited, non-exclusive right to:

  • Store;
  • Process;
  • Transcribe;
  • Analyze;
  • Temporarily reproduce

uploaded content solely for the purpose of providing the Service.

You represent and warrant that:

  • You own or have the legal right to upload and process the content;
  • You have obtained any necessary participant or speaker consents where legally required.

6. AI Output Disclaimer

AI-generated outputs may contain inaccuracies, omissions, hallucinations, or formatting issues.

MediaScriber.ai, a product of Brainstormer Innovations Inc. does not guarantee:

  • Perfect transcription accuracy;
  • Correct speaker identification;
  • Error-free summaries or translations.

Users are responsible for reviewing outputs before relying on them for business, legal, medical, compliance, or publication purposes.

7. Data Retention

Unless otherwise specified:

  • Uploaded files and generated outputs may be stored temporarily to provide and improve the Service;
  • MediaScriber.ai, a product of Brainstormer Innovations Inc. may automatically delete uploaded media and generated content after a retention period determined by the Platform.

Enterprise customers may negotiate custom retention policies.

8. API Usage

API users must:

  • Keep API credentials secure;
  • Comply with rate limits and fair usage rules;
  • Not abuse or attempt to bypass usage restrictions.

Paid plans may include subscription fees, usage-based billing, or prepaid credits.

You authorize MediaScriber.ai, a product of Brainstormer Innovations Inc. and its payment providers to charge the payment method associated with your account.

Failure to pay may result in:

  • Suspension of services;
  • Restriction of access;
  • Deletion of account data after applicable notice periods.

10. Intellectual Property

The Platform, including its software, workflows, branding, and proprietary systems, remains the property of MediaScriber.ai, a product of Brainstormer Innovations Inc. and its licensors.

Users may not:

  • Copy;
  • Resell;
  • Reverse engineer;
  • Republish;
  • Redistribute

any part of the Platform without written authorization.

11. Third-Party Services

The Platform may rely on or integrate with third-party AI models, cloud providers, storage providers, or APIs.

MediaScriber.ai, a product of Brainstormer Innovations Inc. may use multiple third-party providers and reserves the right to add, remove, substitute, or modify underlying infrastructure providers, AI models, transcription engines, diarization systems, or related technologies at any time in order to improve performance, reliability, pricing, regional availability, scalability, compliance, or user experience.

Users acknowledge that:

  • Output quality, formatting, latency, and functionality may vary between providers or models;
  • Certain features may depend on third-party provider availability;
  • MediaScriber.ai, a product of Brainstormer Innovations Inc. is not responsible for outages, failures, inaccuracies, retention policies, or service interruptions caused by third-party providers.

MediaScriber.ai, a product of Brainstormer Innovations Inc. does not guarantee the continued use of any specific AI model, vendor, provider, or technology stack.

12. Service Availability

The Platform may rely on or integrate with third-party AI models, cloud providers, storage providers, or APIs.

MediaScriber.ai, a product of Brainstormer Innovations Inc. is not responsible for outages, failures, or inaccuracies caused by third-party providers.

MediaScriber.ai, a product of Brainstormer Innovations Inc. does not guarantee uninterrupted or error-free operation.

Scheduled maintenance, outages, infrastructure failures, or model-provider disruptions may affect availability.

13. Limitation of Liability

To the maximum extent permitted by law, MediaScriber.ai, a product of Brainstormer Innovations Inc. shall not be liable for:

  • Indirect or consequential damages;
  • Loss of profits;
  • Loss of data;
  • Business interruption;
  • Errors in AI-generated outputs.

Total liability shall not exceed the amount paid by the user to MediaScriber.ai, a product of Brainstormer Innovations Inc. in the preceding 3 months.

14. Indemnification

You agree to indemnify and hold harmless MediaScriber.ai, a product of Brainstormer Innovations Inc., its directors, employees, and affiliates against claims arising from:

  • Your use of the Service;
  • Your uploaded content;
  • Violations of these Terms;
  • Violations of applicable law.

15. Suspension and Termination

MediaScriber.ai, a product of Brainstormer Innovations Inc. may suspend or terminate access if:

  • These Terms are violated;
  • Payment obligations are not met;
  • Usage presents legal, security, or operational risk.

Users may stop using the Service at any time.

16. Privacy

Use of the Platform is also governed by the Privacy Policy.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the state or federal courts located in Delaware.

To the maximum extent permitted by law, users agree that:

  • Claims must be brought in an individual capacity and not as part of a class action;
  • MediaScriber.ai, a product of Brainstormer Innovations Inc.’s total aggregate liability shall remain limited as set forth in these Terms.

Nothing in these Terms limits any non-waivable consumer rights that may apply under local law in the user’s jurisdiction.

18. Changes to Terms

These Terms shall be governed by and construed in accordance with the laws of India.

Courts located in Mumbai, Maharashtra shall have exclusive jurisdiction.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.
